Possession limits for dried cannabis in public places are also specified, with some sources mentioning up to 100 grams.
  • Commercial cultivation and trade remain restricted under existing laws, primarily the Medicines and Related Substances Act. This means that selling or exchanging cannabis for any form of compensation is still illegal for unlicensed individuals.
  • The Act does not provide a legal framework for cannabis clubs or dispensaries that engage in the commercial trading of cannabis internally. These operate in a legal grey area.
  • Limited commercial activities are permitted under licenses issued by the South African Health Products Regulatory Authority (SAHPRA), mainly for medicinal cannabis production and export.
  • Hemp, defined as cannabis with a THC content of less than 0.2%, is regulated separately by the Department of Agriculture under the Plant Improvement Act.
